PATENT LAW TREATY ENTERS INTO FORCE

In this connection the date of filing applications for patents for inventions, utility models, received by the National Center of Intellectual Property no earlier than October 21, 2016, will be established on the date of receipt of the following documents:

application for grant of a patent for an invention, utility model;

description of an invention, utility model;

drawings, if the description refers to them.

If these documents are not presented simultaneously, the filing date of an application for a patent for an invention, utility model will be determined by the date of receipt of the last document.

In addition, the missing deadline for submitting a request for patent examination of an application for a patent for an invention (paragraph 1 of Article 21 of the Law of the Republic of Belarus on December 16, 2002 “On Patents for Inventions, Utility Models and Industrial Designs”) that on October 21, 2016 was not expired, will be restored at the applicant's request on the conditions and in the manner provided for in Article 27 of the Law of the Republic of Belarus “On Patents for Inventions, Utility Models and Industrial Designs”.

In accordance with the said Article the missed terms by an applicant, at his/her request may be restored by the National Center of Intellectual Property on conditions that the patent fee payment in the established amount is carried out, and there are valid reasons for missing the applicable time limit.

The renewal request may be filed by an applicant to the National Center of Intellectual Property within twelve months from the date of expiry of the missed deadline.

In respect of the renewal of terms at the request of an applicant, the National Center of Intellectual Property cancels the earlier decision to refuse the grant of a patent.
