On April 9, 2021, the Head of State signed the Law of the Republic of Belarus “On Accession of the Republic of Belarus to the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs” (hereinafter – the Law).

The adoption of the law is aimed at finalizing domestic procedures required for the accession of the Republic of Belarus to the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs (hereinafter – the Geneva Act), adopted at the Diplomatic Conference in Geneva on July 2, 1999.

The Geneva Act regulates the operation of an international system for registration and legal protection of industrial designs (appearance (design) of products).

Currently, 65 states, including the Russian Federation, the Republic of Armenia, the Republic of Azerbaijan, the Kyrgyz Republic and others are states parties to the Geneva Act.

The implementation of the Geneva Act will simplify the procedures for Belarusian applicants seeking legal protection of industrial designs and enable maintenance of the respective patents in force at the same time on the territory of all states parties to the Geneva Act.

To obtain a patent for an industrial design in any state party to the Geneva Act, you will need to draft one international application in one language and send it to one receiving office (International Bureau of the World Intellectual Property Organization) with minimal expenditures (in the same currency).

Another advantage provided by the Geneva Act is that it reduces the expenditures of Belarusian applicants seeking legal protection of their industrial designs at the same time on the territory of several states parties to the abovementioned act.
