Thereby, from January 1, 2014 a single scale of patent fees in the Republic of Belarus for residents and non-residents of the Republic of Belarus is functioning.

Patent fees are calculated by payers in foreign currency at the rates established in U.S. dollars or Swiss francs.

Payment of patent fees is carried out by:

  • payers – residents of the Republic of Belarus – in Belarusian rubles at the official rate of the National Bank of the Republic of Belarus, applicable at the date of payment;
  • payers – non-residents of the Republic of Belarus – in foreign currency (U.S. dollars, euros, Swiss francs, Russian rubles) in the amount determined using the cross-rate, calculated on the basis of the official exchange rates of the Belarusian ruble in respect of the relevant foreign currencies, determined by the National Bank of the Republic of Belarus on the payment date.

If patent fee payer is a non-resident of the Republic of Belarus, the patent fee shall be paid by:

  • patent attorney of the Republic of Belarus in foreign currency (U.S. dollars, euros, Swiss francs, Russian rubles) in an amount calculated basing on the official exchange rate determined by the National Bank of the Republic of Belarus on the day of payment;
  • resident of the Republic of Belarus, acting on behalf of the payer (except patent attorney of the Republic of Belarus) in Belarusian rubles at the official rate of the National Bank of the Republic of Belarus, applicable at the date of payment (paragraph 1 of Article 264 of TC as amended by the Law).

Simultaneously the Law establishes benefits in respect of patent fees.

Thereby, payers – individuals are exempted from patent fees such as:

  • Heroes of the Soviet Union, Heroes of Socialist Labour, Heroes of the Republic of Belarus, Full Cavaliers of the Order of Glory, Labor Glory and for Merit to the Fatherland;
  • World War II veterans, veterans of military activities in territories of other states, disabled war veterans of the Great Patriotic War, disabled war veterans of military activities in territories of other states, family members of military personnel, partisans and members of underground organizations, dead (deceased) in the Great Patriotic War and in the performance of military (service) obligations referring to Articles 2 - 4 and 22 of the Law “On Veterans”;
  • liquidators of the Chernobyl disaster;
  • group I disability.

Other taxpayers – individuals pay 25 percent of the established amount of patent fees.

These benefits are not available with respect to legally significant acts for which the patent fee is charged in accordance with paragraphs 38 - 62, 66 - 69, 71 - 77 of Annex 23 of the TC.

Article 263 of the Tax Code as amended by the Law provides other benefits.

With respect to individual fees for trademark registration on the territory of the Republic of Belarus in accordance with the Madrid Agreement Concerning the International Registration of Marks and the Protocol Relating to the Madrid Agreement the rates are remained unchanged.
