The first issue of the journal «Intellectual Property in Belarus» published an article by Polina Katsubo (Specialist of the Commercialization Support Division of the Department for Commercialization Support and State Registers of the National Center of Intellectual Property) and Dzmitry Andryieuski (Head of the Department for Commercialization Support and State Registers of the National Center of Intellectual Property) «Problematic issues arising in the registration of agreements on assignment of exclusive rights to objects of industrial property rights».


The Republic of Belarus has established mandatory registration of transactions in respect of certain objects of industrial property rights, and about half of all agreements submitted for registration are agreements on assignment of exclusive rights. When registering such agreements, the documents submitted are checked. The provisions of the agreement are checked for compliance with the norms of legislation in the field of intellectual property.

The authors analyze the mistakes that are made when submitting documents for the registration of an agreement. Applicants face difficulties in determining the essential terms of the agreement on assignment, the possibility of its termination and amendment. Proposals are made to reflect these issues in the agreement, and the established procedure for registration of these agreements in the Republic of Belarus is compared with the system existing in the Russian Federation.
